Fitney is a service provided by WheelHouse Software Ltd, a company registered in Scotland, UK. By using Fitney, you agree to these terms.

Your Account

  • You must be at least 16 years old to use Fitney
  • You're responsible for keeping your account secure
  • Don't share your account with others
  • Provide accurate information when signing up
  • We may suspend or terminate accounts that violate these terms

AI-Powered Features

Fitney uses artificial intelligence (powered by Anthropic's Claude) to provide conversational workout tracking and suggestions.

  • AI-generated suggestions are not professional fitness or medical advice
  • Your conversations are processed by our third-party AI provider
  • AI may occasionally make mistakes—please verify important information
  • Do not rely solely on AI suggestions for health or fitness decisions

Subscriptions and Billing

Fitney offers subscription plans through the Apple App Store:

  • Subscriptions are purchased and billed through Apple
  • Billing is managed by Apple and subject to their terms
  • To cancel, use your App Store account settings
  • Refunds are handled by Apple according to their policies
  • Price changes will be communicated in advance as required by applicable law

Acceptable Use

Please don't:

  • Use Fitney for anything illegal
  • Try to hack or disrupt the service
  • Create multiple accounts to abuse the system
  • Share content that's harmful or offensive
  • Attempt to circumvent subscription features

Your Content

You own your workout data. By using Fitney, you grant us a licence to store and process your data to provide the service. You can export or delete your data at any time.

Intellectual Property

  • Fitney and its original content, features, and functionality are owned by WheelHouse Software Ltd
  • You retain ownership of your personal workout data
  • We grant you a limited, non-exclusive licence to use the service for personal, non-commercial purposes

Termination

  • You may delete your account at any time through the app
  • We may suspend or terminate accounts that violate these terms
  • Upon termination, your right to use the service ceases immediately
  • Your data will be handled according to our Privacy Policy

Disclaimer

Fitney is a workout tracking tool, not a substitute for professional medical or fitness advice.

  • Always consult with qualified healthcare professionals before starting a new exercise programme
  • AI suggestions are for informational purposes only and should not replace professional guidance
  • Stop exercising and seek medical attention if you experience pain, dizziness, or discomfort
  • You are solely responsible for your fitness activities and decisions

Limitation of Liability

To the maximum extent permitted by applicable law:

  • The service is provided "as is" without warranties of any kind
  • We do not warrant that the service will be uninterrupted or error-free
  • Our total liability is limited to the fees you paid us in the 12 months prior to the claim
  • We are not liable for indirect, incidental, or consequential damages

Note: Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or your statutory rights as a consumer in the UK or EU.

Indemnification

You agree to indemnify and hold harmless WheelHouse Software Ltd from any claims, damages, or expenses arising from your misuse of the service or violation of these terms. This does not apply to the extent prohibited by applicable consumer protection laws.

Changes to Terms

We may update these terms from time to time. We'll notify you of significant changes through the app or email. Continued use after changes constitutes acceptance of the new terms.

Governing Law and Disputes

These terms are governed by the laws of Scotland, UK. The courts of Scotland have exclusive jurisdiction over any disputes.

Note: This does not affect your statutory rights as a consumer under UK or EU law, including any rights to bring claims in your local courts.

Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and WheelHouse Software Ltd regarding Fitney.
